Appellant instituted this action alleging that the Ohio Department of Insurance (ODI) and various insurance companies have conspired to deprive her and her class of their right to receive insurance on the basis of sex and marital status. She alleged that these conspiratorial acts violated her Fourteenth Amendment rights of due process and equal protection and gave rise to a cause of action under 42 USC §Â§ 1983 and 1985(3). The district court concluded that because the Eleventh Amendment immunity has been extended to state agencies, it had no subject matter jurisdiction to entertain the action against the ODI. Edelman v. Jordan, 415 U.S. 651 (1974). Accordingly, the claims against the ODI were dismissed. Upon motions to dismiss by some of the defendants for failure to state a claim upon which relief could be granted, the district court determined the claim to be frivolous and dismissed it as against all of the defendants.
